1. Provider and acceptance
These Terms are between you, or the organization you represent, and Ronald Telford, provider of the Tervalum Systems software portfolio. By using this website, submitting an order, or downloading purchased software, you agree to the applicable website and purchase terms.
2. Products and separate EULAs
FieldFindings Professional, WorkplaceFindings Professional, and Investigator Professional are licensed, not sold. Each product is governed by its applicable End User License Agreement. If these website terms conflict with an EULA concerning use of the software, the EULA controls.
3. Orders and payment providers
Displayed prices and offers remain subject to availability until checkout is completed. A merchant-of-record provider such as Lemon Squeezy may separately handle checkout, payment, tax, fraud screening, receipts, refunds, and chargebacks. Complete card details are not collected through the Tervalum website itself.
Investigator Professional is displayed at its planned $399 one-time price but is not presently available for purchase.
4. Electronic delivery and activation
Download instructions, receipts, serial numbers, activation information, and transaction notices may be delivered electronically. Customers are responsible for accurate purchaser information and for protecting licence and download records.
5. Customer responsibility
Customers are responsible for lawful use, authority to collect and process assessment or investigation information, protection of local data and credentials, review of generated reports, and applicable professional, organizational, and legal requirements.
6. No legal or professional advice
The website, guides, resources, demonstrations, and software provide general information and record-management tools. They do not provide legal advice or guarantee compliance, safety, investigative fairness, evidentiary reliability, or any particular professional result.
7. Local customer data
The desktop products are designed around customer-controlled Windows storage. Sales and licensing services are not intended to receive customers' assessment projects, investigation cases, evidence, reports, application passwords, or encryption material.
8. Refunds and warranties
Refund eligibility and any limited warranty are governed by the applicable EULA, published Refund Policy, payment-provider terms, and non-waivable law.
9. Governing law
These Terms are governed by Iowa law except where non-waivable law requires otherwise. Product-specific venue provisions are governed by the applicable EULA.
